MOZAMBIQUE - GOVERNANCE AND HUMAN RIGHTS
Investiture of Members may violate the constitution
According to the law, members of the Assembly of the Republic (AR) are vested in office within fifteen days after publication of final results of the elections. The publication of results comes after the announcement of results by the Constitutional Council (CC). In terms of time, the CC has a maximum of 55 days for the proclamation and validation of results. However, if Members of Parliament take office in December, will be a clear violation of the constitution, because there will be a term beginning before the end of another. Thus, the current term began in January 2005, it can only end in February 2010 and not December of this year. The other problem is financial: the current members are employed with a budget already approved by the AR.
